1Agreement to Terms

These Terms of Use ("Terms") govern access to and use of Rowi, including the Rowi mobile application for iOS and Android, website, and related services (collectively, the "Services") provided by POSITIVE COMMUNICATIONS LLC ("Rowi," "we," "us," or "our").

By creating an account, accessing, or using the Services, the user agrees to these Terms. If the user does not agree, the user must not use the Services.

2Eligibility

Users must be at least 18 years old to use Rowi. By using Rowi, the user represents that the user is 18 years of age or older and has the legal capacity to enter into these Terms.

3The Rowi Service

Rowi is a productivity, task organization, personal goals, and AI-assisted planning app. Rowi may help users organize tasks, goals, routines, productivity inputs, and related information. Rowi may provide AI-generated suggestions, summaries, reminders, insights, or recommendations.

Rowi is currently offered for free for a limited or indefinite period. We may later introduce donations, paid features, subscriptions, in-app purchases, premium plans, or other monetization models. We will provide any required notices or terms before paid features are introduced.

4Account Registration and Security

Users may create an account using email, Google Sign-In, Apple Sign-In, or other methods we make available. Users are responsible for maintaining the confidentiality of account credentials and for all activity under their accounts.

Users must provide accurate information and keep account information up to date. If a user believes an account has been compromised, the user should contact support@getrowi.app immediately.

5User Content

Users may enter, upload, submit, or store information in Rowi, including tasks, goals, notes, photos, personal metrics, preferences, and other materials ("User Content"). Users retain ownership of their User Content.

By using the Services, users grant Rowi a limited, worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and use User Content solely as necessary to operate, provide, secure, improve, and support the Services, including AI-assisted features selected or used by the user.

Users are responsible for ensuring they have the rights and permissions necessary to provide User Content to Rowi.

6AI Features and Limitations

Rowi may use third-party AI providers, which may include OpenAI, Google Gemini, Anthropic, or similar providers selected by us, to process user inputs and generate outputs.

AI outputs may be inaccurate, incomplete, outdated, misleading, or unsuitable for a user situation. Users are responsible for reviewing AI outputs before relying on them.

Rowi does not provide medical, psychological, legal, tax, accounting, financial, investment, employment, or other professional advice. Any information related to productivity, habits, goals, body metrics, routines, or personal performance is informational only and should not replace professional advice.

7Health, Body Metrics, and Personal Data Disclaimer

Rowi may allow users to provide age, height, weight, photos, goals, habits, and related personal information. Rowi is not a healthcare provider and does not diagnose, treat, cure, or prevent any condition. Users should consult qualified professionals before making health, fitness, nutrition, medical, psychological, legal, or financial decisions.

8Acceptable Use

Users agree not to:

• Use Rowi for unlawful, harmful, abusive, fraudulent, deceptive, or infringing purposes.
• Upload content that violates rights of others, including privacy, publicity, intellectual property, or confidentiality rights.
• Attempt to reverse engineer, scrape, crawl, copy, modify, or create derivative works from the Services except as permitted by law.
• Interfere with, disrupt, overload, or compromise the security or integrity of the Services.
• Use bots, scripts, or automated methods to access the Services without authorization.
• Attempt to bypass usage limits, account restrictions, security measures, or authentication mechanisms.
• Use the Services to generate content that is illegal, harmful, abusive, discriminatory, harassing, deceptive, or violates third-party rights.
• Misrepresent identity, affiliation, or account ownership.

9App Stores and Platform Terms

Use of the Rowi app may also be subject to the terms and policies of Apple App Store, Google Play, and the user mobile operating system. The app stores are not responsible for providing support for Rowi unless required by their terms.

10Privacy

Our Privacy Policy explains how we collect, use, disclose, and protect personal information. The Privacy Policy is available at https://getrowi.app/privacy-policy and inside the app. By using Rowi, users acknowledge the Privacy Policy.

11Account and Data Deletion

Users may request deletion of their Rowi account and associated data through the app by going to Settings > Account > Delete Account, or through the web resource at https://getrowi.app/delete-account.

Deleting an account may permanently delete account access and associated personal data, except information we may retain where required or permitted by law, security, fraud prevention, dispute resolution, or compliance purposes.

12Future Payments, Donations, and Subscriptions

Rowi is currently free. If we introduce donations, subscriptions, premium features, in-app purchases, or paid services, we will provide additional terms, pricing, renewal, cancellation, refund, and billing information where required. App store payment terms may apply to purchases made through Apple or Google.

13Intellectual Property

The Services, including the Rowi name, logos, design, software, features, text, graphics, interfaces, and other materials, are owned by POSITIVE COMMUNICATIONS LLC or its licensors and are protected by intellectual property laws. Except for rights expressly granted in these Terms, we reserve all rights in the Services.

Users may not use Rowi trademarks, logos, branding, or content without prior written permission.

14Copyright and DMCA Notices

If a copyright owner believes that content on or through Rowi infringes copyright, the owner may send a notice to our DMCA contact at dmca@getrowi.app.

DMCA notices should include the required information described in our DMCA / Copyright Policy, including identification of the copyrighted work, identification of the allegedly infringing material, contact information, a good-faith statement, an accuracy statement under penalty of perjury, and the signature of the complaining party or authorized agent.

Rowi may remove or disable access to allegedly infringing content and may terminate repeat infringers where appropriate.

15Feedback

If users provide feedback, ideas, suggestions, or recommendations about Rowi, users grant us the right to use that feedback without restriction or compensation.

16Third-Party Services

The Services may include or rely on third-party services, SDKs, APIs, AI providers, analytics providers, authentication providers, app stores, websites, or integrations. We are not responsible for third-party services, and their terms and privacy policies may apply.

17Service Changes and Availability

We may modify, suspend, discontinue, or restrict access to any part of the Services at any time. We do not guarantee that the Services will be uninterrupted, error-free, secure, or available at all times.

18Suspension and Termination

We may suspend or terminate access to Rowi if we believe a user has violated these Terms, created risk or legal exposure, engaged in abuse, or used the Services in a way that may harm Rowi, other users, or third parties.

Users may stop using Rowi at any time and may request account deletion as described in these Terms.

19Disclaimers

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and reliability.

We do not guarantee that Rowi will improve productivity, performance, health, fitness, financial outcomes, business outcomes, or personal goals.

20Limitation of Liability

To the fullest extent permitted by law, Rowi and its owners, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, reputational harm, or loss of goodwill arising out of or related to the Services.

To the fullest extent permitted by law, our total liability for all claims arising out of or related to the Services will not exceed the greater of (a) the amount paid by the user to Rowi in the twelve months before the event giving rise to liability, or (b) USD $100.

21Indemnity

Users agree to defend, indemnify, and hold harmless Rowi, POSITIVE COMMUNICATIONS LLC, and their respective owners, officers, employees, contractors, affiliates, and service providers from claims, damages, liabilities, losses, and expenses arising from User Content, misuse of the Services, violation of these Terms, violation of law, or violation of third-party rights.

22Governing Law and Dispute Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles, unless applicable consumer protection law requires otherwise.

Venue for disputes will be in the state or federal courts located in Miami-Dade County, Florida, unless applicable law requires a different venue. This section should be reviewed by counsel before publication.

23Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice through the app, website, email, or other reasonable means. Continued use of Rowi after updated Terms become effective means the user accepts the updated Terms.
