1Overview
POSITIVE COMMUNICATIONS LLC respects intellectual property rights and expects Rowi users to do the same. This DMCA and Copyright Policy explains how copyright owners may report alleged copyright infringement involving Rowi and how users may respond if content is removed or disabled.
This policy should be reviewed by U.S. counsel before publication, especially if Rowi hosts user-generated content or wants to rely on safe harbor protections under the U.S. Digital Millennium Copyright Act (DMCA).
2DMCA Contact
DMCA notices may be sent to: dmca@getrowi.app.
DMCA Agent: Positive Communications LLC DMCA Agent.
Mailing address: 2 S Biscayne Boulevard, Suite 3200 #742, Miami, FL 33131.
Important: If Rowi intends to rely on DMCA safe harbor protections for user-generated content, POSITIVE COMMUNICATIONS LLC should evaluate registering a designated agent with the U.S. Copyright Office DMCA Designated Agent Directory.
3Reporting Copyright Infringement
If a copyright owner or authorized agent believes that material available through Rowi infringes a copyright, the owner may send a written notice to the DMCA contact identified above.
4Required Information for a DMCA Notice
A DMCA notice should include substantially the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.
- Identification of the material claimed to be infringing and information reasonably sufficient to allow Rowi to locate the material.
- The complaining party contact information, including name, address, telephone number, and email address.
- A statement that the complaining party has a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of the exclusive right allegedly infringed.
5Action After Receiving a Notice
After receiving a valid notice, Rowi may remove or disable access to the allegedly infringing material, notify the affected user where appropriate, and take additional steps required or permitted by law.
Rowi may terminate accounts of users who are repeat infringers where appropriate.
6Counter-Notice
If a user believes that content was removed or disabled by mistake or misidentification, the user may send a counter-notice to the DMCA contact.
7Required Information for a Counter-Notice
A counter-notice should include substantially the following:
- The user physical or electronic signature.
- Identification of the material that was removed or disabled and the location where the material appeared before it was removed or disabled.
- A statement under penalty of perjury that the user has a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- The user name, address, telephone number, and email address.
- A statement that the user consents to the jurisdiction of the federal district court for the judicial district in which the user address is located, or if outside the United States, for any judicial district in which Rowi may be found, and that the user will accept service of process from the person who submitted the original notice or that person agent.
8Restoration of Material
If Rowi receives a valid counter-notice, Rowi may restore the removed material unless the original complaining party files an action seeking a court order to restrain the user from engaging in infringing activity and notifies Rowi as required by law.
9False or Misleading Notices
Submitting false, misleading, or bad-faith notices or counter-notices may result in legal liability. Anyone uncertain about rights or obligations should consult legal counsel before submitting a notice or counter-notice.
